1. Purpose of the Terms and Conditions of Sale
These Terms and Conditions of Sale (hereinafter referred to as the “Terms” or “TCS”) constitute a contractual agreement between KingEshop Corp. , a company duly incorporated in Canada (hereinafter “KingEshop”, “we”, or “our”), and any individual or legal entity (hereinafter the “client”, “you”, or “your”) subscribing to a plan or purchasing a service or product offered by KingEshop. These TCS govern access to and use of our services, as well as the conditions applicable to any order placed on the kingeshop.com website. They are deemed fully accepted upon order confirmation.
2. Seller Identification
The website kingeshop.com is published and operated by KingEshop Corp., a company incorporated in Canada. All legal information concerning the company (registered address, registration number, contact details) is available on the Legal Notice page of the website.
3. Description of Services
KingEshop is an online platform (SaaS) that allows clients to create, manage, and publish an online store, as well as access various digital services related to e-commerce. The services available depend on the plan selected by the client at the time of ordering and may include, without limitation, store management tools, technical features, hosting services, security, or support. Full details regarding the content of the offers, their duration, pricing, and related terms are provided on the website at the time of the order.
4. Access to the Service and Account Creation
To access KingEshop’s services, the client must create an account by providing accurate, complete, and up-to-date information. The client agrees to keep this information current throughout the duration of their use of the service.
A secure password is automatically assigned to the client upon account creation. For security reasons, the client agrees to change this password as soon as possible after the first login and to choose a personal, strong, and confidential password.
The client is solely responsible for the confidentiality of their login credentials and for all activities conducted from their account. They agree not to share their access with third parties, except where explicitly authorized by their subscription. In case of suspected unauthorized use, the client must notify KingEshop without delay.
Use of the platform requires an Internet connection and a compatible device. These resources, as well as any associated costs, are the sole responsibility of the client.
5. Pricing and Payment Terms
The applicable prices are those displayed on the kingeshop.com website at the time of the order. They are expressed in euros, Canadian dollars, or US dollars, depending on the currency shown on the relevant sales page.
Payment is due in full at the time of the order. It is made by credit card through secure payment providers such as Stripe or PayPal.
The client acknowledges that any confirmed order constitutes a firm, final, and non-refundable sale. It is the client’s responsibility to ensure that the selected offer suits their needs before making the payment.
KingEshop reserves the right to modify its prices at any time for future orders. The prices in effect at the time of the order remain guaranteed for the duration of the subscribed plan.
Applicable taxes, if any, are specified before the order is confirmed and are the responsibility of the client.
6. Term, Termination, and Suspension
Subscriptions offered by KingEshop have a fixed duration, as indicated at the time of order. Unless otherwise stated, they are automatically renewed upon expiration for an identical period, unless the client cancels the subscription before the renewal date.
One-time products or services, when offered, are subject to these Terms and Conditions but are not automatically renewed.
KingEshop reserves the right to suspend or terminate access to its services, temporarily or permanently, without notice and without compensation, in the following cases:
– abusive, threatening, or disrespectful behavior toward the KingEshop team;
– fraudulent, unlawful, or clearly improper use of the service;
– use of the service for manipulating search engines, exploiting artificial links, or activities related to spam indexing;
– use of the service or hosted site to damage the reputation of KingEshop, directly or indirectly;
– violation of these Terms and Conditions;
– or any other reason deemed legitimate by KingEshop, including in the absence of client misconduct.
The client expressly acknowledges that such termination may be exercised unilaterally by KingEshop, for any reason whatsoever, without obligation to refund, compensate, or justify.
By accepting these Terms and Conditions, the client irrevocably waives any claim, compensation, indemnity, or financial recourse against KingEshop, regardless of the cause, origin, or nature, including in the event of alleged harm, business loss, loss of revenue, image, data, or even in the event of fault or negligence on the part of KingEshop.
In any case, KingEshop’s maximum financial liability to a client is strictly limited to the last amount actually paid by that client.
7. Right of Withdrawal
In accordance with European Directive 2011/83/EU on consumer rights, the right of withdrawal does not apply to contracts for the supply of digital content not provided on a physical medium, where performance has begun with the consumer’s prior express consent and acknowledgment of the loss of their right of withdrawal.
By confirming their order and immediately accessing KingEshop’s services, the client expressly acknowledges that the service begins immediately and that they thereby waive any right of withdrawal.
As a result, all orders are final, definitive, and non-refundable.
8. Responsibilities and Limitations
KingEshop makes every effort to ensure continuous, secure, and functional access to its platform. However, due to the nature of internet technologies and hosting infrastructures, the service may be temporarily interrupted or disrupted, particularly for maintenance, updates, or external causes beyond KingEshop’s control.
The client acknowledges that they use KingEshop’s services at their own risk. It is their responsibility to ensure that the platform meets their technical, commercial, and legal needs.
KingEshop does not guarantee the commercial success of any site created via the platform, nor any specific ranking on search engines, nor any particular performance level.
Under no circumstances shall KingEshop be held liable for:
– loss of revenue, data, reputation, or customers;
– errors, omissions, or faults resulting from improper or non-compliant use of the service;
– or indirect damages, even if KingEshop was advised of their possibility.
The client expressly acknowledges that KingEshop’s maximum financial liability, regardless of the cause or reason (including in the case of fault, negligence, or failure on the part of KingEshop), is strictly limited to the last amount actually paid by the client.
No additional compensation or indemnity may be claimed under any circumstances.
9. Personal Data
KingEshop places great importance on the protection of its clients’ personal data. The data collected when creating an account, using the services, or contacting our team is processed confidentially and securely.
This data is used solely for managing client accounts, providing access to services, technical support, and, subject to the client's consent, for sending commercial communications, newsletters, or information related to KingEshop and its services.
In accordance with applicable regulations, including the General Data Protection Regulation (GDPR) for European clients and Canadian privacy laws, the client has the right to access, rectify, delete, and port their personal data, which may be exercised by contacting KingEshop at info@kingeshop.com.

10. Intellectual Property
All elements comprising the KingEshop platform — including its structure, design, features, source code, text, images, logos, databases, and more generally any original content provided by KingEshop — are the exclusive property of KingEshop Corp. and are protected under applicable intellectual property laws.
Any reproduction, representation, distribution, extraction, or use, in whole or in part, of these elements without prior written authorization from KingEshop is strictly prohibited and may result in legal action.
The client remains fully responsible for any texts, images, logos, videos, or other content that they upload or create in their own online store. They guarantee that they hold all necessary rights to use such content, and agree not to publish counterfeit, illegal, or infringing materials.
It is strictly forbidden to use the KingEshop platform to offer, sell, or promote counterfeit products or any goods that infringe intellectual property rights. The client acknowledges full responsibility for the content and products they publish, and agrees to indemnify KingEshop against any claims or actions arising from the violation of third-party rights. In the event that counterfeit content or products are detected, KingEshop reserves the right to immediately and without notice close the relevant store, with no compensation or refund.
11. Prohibited Products and Content
In accordance with Article 10 of these Terms and Conditions, it is strictly forbidden to use the KingEshop platform to offer, sell, or promote counterfeit products or items that infringe intellectual property rights.
In addition, clients agree not to offer on their online store any products, services, or content falling into the following categories, without this list being exhaustive:
– firearms, ammunition, explosives, or related accessories;
– drugs, illegal substances, or similar products;
– pornographic, sexually explicit, hateful, or violent content;
– services related to illegal or unauthorized gambling;
– cryptocurrencies, digital tokens, or services related to unregulated digital assets;
– organs, bodily fluids, misused medical products, or any goods contrary to morality or applicable laws;
– products whose sale is restricted or prohibited in certain countries or jurisdictions.
KingEshop reserves the right, at its sole discretion, to prohibit at any time the sale of any product, service, or content it deems inappropriate or incompatible with its policies or values, without prior justification.
Any violation of these rules may result in the immediate and without-notice closure of the store concerned, without compensation or refund, in accordance with Article 6 of these Terms and Conditions.
12. Responsibility Towards End Customers
The stores created via the KingEshop platform are fully managed by KingEshop's clients, who are solely responsible for them. KingEshop acts solely as a provider of technical infrastructure and is not a party to any commercial, contractual, or legal relationship between its clients and their end customers.
Occasionally, KingEshop may receive messages or complaints directly from end customers. In such cases, KingEshop reserves the right to respond or redirect the request to the relevant merchant, without this constituting any involvement or responsibility in the handling of the matter.
Each client agrees to fully manage their commercial activity, including the relationship with their end customers. This includes, but is not limited to, order processing, billing, delivery, after-sales support, complaint handling, and any other aspect related to the proper execution of their obligations.
In the event of repeated, serious, or substantiated reports of poor management (such as lack of response, delivery, or proper resolution), KingEshop reserves the right to suspend or delete the affected store, without compensation or refund, in order to protect the integrity of its platform and prevent disputes or confusion.
13. Applicable Law and Jurisdiction
These Terms and Conditions are governed by and interpreted in accordance with the laws in force in the province of Quebec (Canada), to the exclusion of any other legislation. In the event of a dispute concerning the interpretation or execution of these Terms, the parties agree to first seek an amicable resolution. Failing that, exclusive jurisdiction is assigned to the courts of the judicial district of Laval, province of Quebec, Canada. This clause is subject to mandatory consumer protection provisions applicable in the client’s country of residence, when such provisions cannot be contractually waived.

In case of discrepancy, ambiguity, or conflict between the translated versions and the original French version, only the French version shall be legally binding.
